The bill is co-sponsored by Representative Sean Brennan from Parma. It aims to ensure that individuals applying for or receiving Medicaid are adequately informed about the Estate Recovery Program. The bill mandates that applicants receive clear, written explanations at both the application and approval stages. These explanations are intended to help individuals and families make informed financial decisions and explore legal options such as estate planning while adhering to Medicaid regulations.

Representative LaRe highlighted the importance of this legislation by stating, “Too many Ohioans have been adversely affected due to lack of notification and comprehensive understanding of the state recovery program.” He emphasized that the bill ensures people receive a clear explanation twice, so they understand what to expect before becoming Medicaid recipients who might be impacted.

The key provisions of House Bill 130 include requirements for the Ohio Department of Medicaid (ODM) to provide clear notifications explaining the Estate Recovery Program during both application and approval processes. Additionally, ODM is directed to create consumer-friendly materials that outline how the program operates, including examples and details about asset recovery and resources for those at risk. Furthermore, ODM must adopt rules to implement and enforce these notification requirements.

With its passage in the House, House Bill 130 will now proceed to the Senate for further consideration.
